Terms of Service
Don Sweet Law PLLC, Donald J. Sweet A Professional Corporation and Don Sweet, Esq. Effective Date: September 7, 2026
These Terms of Service ("Terms") govern your access to and use of the public website and the secure client/staff login portal located at donsweetlaw.com (collectively, the "Site"), operated by Don Sweet Law PLLC, and Donald J Sweet A Professional Corporation and Don Sweet, Esq. ("the Firm," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not access or use the Site.
1. Scope of the Portal
This login portal is provided for the exclusive use of clients and staff of the Firm to access their own matter-related information. Access may be revoked at any time without notice. This portal is not a substitute for direct communication with the Firm regarding your legal matter.
2. Authorized Use Only
Access to the secure portal is limited to individuals specifically invited by the Firm. You may not share your login credentials, attempt to access another user's matter information, or attempt to circumvent or probe the Google Sign-In authentication system. Unauthorized access or attempted access may violate state and federal law, including the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and California Penal Code § 502, and may be reported to appropriate authorities.
3. No Attorney-Client Relationship Created by Portal or Website Use
Access to, or use of, the Site — including the secure portal — does not itself create, expand, or modify any attorney-client relationship. The scope of the Firm's representation of any client is governed exclusively by that client's separate, written engagement agreement with the Firm. Nothing on this Site should be understood as an offer to represent any visitor.
4. Not a Substitute for Direct Communication
This portal is not a substitute for direct communication with the Firm regarding your legal matter. Time-sensitive matters, court deadlines, or questions requiring legal judgment or advice must be communicated directly to the Firm by telephone or direct email — do not rely on the portal alone for urgent matters.
5. Attorney Advertising Notice
Portions of the public-facing pages of this Site may constitute "advertising" or a "communication concerning a lawyer's services" as those terms are used in the California Rules of Professional Conduct, rules 7.1 and 7.2, and California Business and Professions Code §§ 6157–6159.2. Nothing on this Site is a guarantee, warranty, or prediction regarding the outcome of any legal matter. Any description of past matters, practice areas, or results on this Site does not guarantee or predict a similar outcome in any future matter, as results depend upon the specific facts and applicable law unique to each case.
6. No Legal Advice; Informational Purposes Only
The content of this Site is provided for general informational purposes only and does not constitute legal advice, nor does it substitute for advice from a licensed attorney familiar with your specific facts and circumstances. Legal information on this Site may not reflect the most current legal developments and may not apply to your situation or jurisdiction. Do not act, or refrain from acting, based on any content on this Site without first consulting a qualified attorney.
7. Jurisdictional Limitation on Practice
Don Sweet Law PLLC and its attorneys are licensed to practice law only in the jurisdictions identified on this Site (currently the State of California, State Bar No. 241137, and the State of Arizona, State Bar No. 020235). Nothing on this Site is intended to constitute the solicitation or provision of legal services in any jurisdiction where the Firm or its attorneys are not authorized to practice. The Firm does not seek to establish an attorney-client relationship with any person based solely on that person's access to this Site from a jurisdiction where doing so would be improper under that jurisdiction's rules governing the unauthorized practice of law.
8. No Improper Solicitation
Nothing on this Site is intended as, and this Site does not constitute, "solicitation" as defined by California Rule of Professional Conduct 7.3, directed toward any person known to be represented by counsel in a matter, or toward any person who has requested not to be contacted by the Firm.
9. Intellectual Property
All content on the Site, including text, graphics, logos, and the underlying practice-management and document tools (including the Firm's internal "LawBrain" system and related applications), is the property of the Firm or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works from Site content without the Firm's prior written consent.
10. Third-Party Services
The secure portal integrates with third-party services, including Google Sign-In and, where applicable, other practice-management, document-storage, and intake-form providers. The Firm is not responsible for the content, security practices, uptime, or availability of any third-party service, and your use of those services is separately governed by their own terms of use and privacy policies.
11. Disclaimer of Warranties
THE SITE AND PORTAL ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. THE FIRM DOES NOT WARRANT THAT THE SITE OR PORTAL WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DON SWEET LAW PLLC AND ITS ATTORNEYS AND STAFF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, OR INABILITY TO ACCESS OR USE, THE SITE OR PORTAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS IS INTENDED TO LIMIT ANY NON-WAIVABLE DUTY OWED BY THE FIRM TO AN ACTUAL CLIENT UNDER THE CALIFORNIA RULES OF PROFESSIONAL CONDUCT OR THE ARIZONA RULES OF PROFESSIONAL CONDUCT.
13. Revocation and Termination of Access
Access may be revoked at any time without notice. The Firm reserves the right, in its sole discretion, to suspend or terminate any individual's portal access at any time, with or without cause, including — without limitation — upon conclusion of the underlying legal matter, non-payment, or a change in the attorney-client relationship.
14. Indemnification
You agree to indemnify, defend, and hold harmless the Firm, its attorneys, and staff from and against any claims, liabilities, losses, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or portal, your violation of these Terms, or your violation of any applicable law.
15. Governing Law and Venue
These Terms are governed by, and will be construed in accordance with, the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site or portal shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. No Waiver
The Firm's failure to enforce any provision of these Terms shall not be construed as a waiver of any provision or right.
18. Changes to These Terms
The Firm may revise these Terms from time to time, and the "Effective Date" above will reflect the date of the most recent revision. Continued use of the Site or portal following any revision constitutes acceptance of the revised Terms.
